  1. Introduction
  • Website Owner. Iron Fist Consultants, LLP (“Iron Fist”) is the owner of website, ironfistconsultants.com (the “Website”). This online privacy notice discloses Iron Fist information practices for the Website, including what type of personal identifiable information is requested in order to make a purchase, how the information is used, and with whom the information is shared. For the purposes of this Privacy Policy, the defined term “Website” shall also be defined to include not only www.ironfistconsultants.com, but also all applicable portals, point of sale services, client assistance tools and services, software, and if applicable, hardware.
  • Anonymous Website Visits. In general, you can visit the Website without disclosing or revealing any personal information. Iron Fist may elect to keep track of the domains from which people visit us.
  • Website Transactions. At times, Iron Fist may need business or personal information regarding a client or a prospect (for the avoidance of doubt, any references herein to a client or prospect shall be deemed to include the employees or representatives of such client or prospect). For example to process an order or provide training services, Iron Fist may need to know a client’s name, mailing address, e-mail address, phone number, and/or credit card details. It is Iron Fist’s intent to inform you before Iron Fist collects personal information, such as user’s name and/or address on the internet. If you tell us that you do not wish to have this information used as a basis for further contact with you, Iron Fist will respect your wishes, although it may take up to four weeks to remove your information from contact lists.
  1. Personal Information That May Be Collected.
  • Identifying Information. In order to make a purchase Iron Fist will request a user to provide certain personal identifying information, which may include: name, postal address, e-mail address, telephone number, method of payment, and, if applicable, credit card number. Iron Fist may request additional information necessary to establish and maintain client’s account.
  • Service Quality Monitoring. Some Website transactions may require a client to contact Iron Fist, or Iron Fist to contact the client. Iron Fist will not contact you by telephone without your prior consent, except in the provision or performance of services requested by client. Client should be aware that it is Iron Fist’s practice to monitor, and in some cases record calls for staff training or quality assurance purposes.
  • Information from Children. It is not Iron Fist’s intention or desire to collect any information from or engage in any transactions with persons under the legal age in their respective country. Our system may nevertheless contain personal data of minors where it is not possible to determine the age of the user, or where the minor’s parent or guardian has consented to the collection of or personally provided such minor information. We reserve the right to block the service from any person who is or whom we reasonably suspect of being a minor who has not first received parental or guardian consent. Iron Fist does not sell products or services for purchase by children and will not intentionally collect or post information from a minor and requests that all minors refrain from providing any information or utilizing or accessing the Website without the consent of a parent or guardian.
  • Lost or Stolen Information. If a client’s credit card and/or password is lost or stolen, the client should promptly notify Iron Fist in order to enable Iron Fist to cancel the lost or stolen information and to update its records with a changed credit card and/or password.
  • Links to Other Websites. The Website may contain links to other websites. Iron Fist is not responsible for the privacy practices or the content of those other websites.
  1. Uses Made of the Information.
  • Limited Uses Identified. Without client’s prior consent, Iron Fist will not use your personal identifiable information for any purpose other than that for which it is submitted. Iron Fist uses personal identifiable information to reply to inquiries, handle complaints, provide operational notices and training programs, and in program record-keeping. Iron Fist may also processes billing and business requests related to Website or consulting program participation.
  • Stored Information Uses. Iron Fist stores and retains the information provided by clients or the information entered on the Website. This information is used to compile a client’s usage history in order to enable Iron Fist to recommend products, services, or special offers that would be of interest to a client, or for such other business reasons as reasonably determined by Iron Fist. Stored information is used by Iron Fist: to support client interaction with Iron Fist and the Website; to deliver client purchases; and/or to contact client about other Iron Fist services and products.
  1. Disclosure of the Information.
  • Mergers and Acquisitions. Circumstances may arise where for business reasons, Iron Fist decides to sell, buy, merge or otherwise reorganize its businesses in the United States or some other country. Such a transaction may involve the disclosure of personal identifying information to prospective or actual purchasers, and/or receiving such information from sellers. It is Iron Fist’s practice to seek appropriate protection for information in these types of transactions.
  • Iron Fist may from time to time choose to employ or engage other companies and individuals to perform business functions on behalf of Iron Fist. These persons may be provided with personal identifying information required to perform their functions but shall be prohibited by contract from using the information for other purposes. These persons may engage in a variety of functions which include, but are not limited to, fulfilling orders, performing or providing consulting and/or training services, removing repetitive information from client lists, analyzing data, providing client assistance, processing credit card payments and providing client services.
  • Marketing Analysis by Third Parties. Iron Fist reserves the right to disclose clients’ personal information to third-parties for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual client.
  • Disclosure to Governmental Authorities. Under certain circumstances, personal information may be subject to disclosure pursuant to a judicial or other government subpoenas, warrants or orders.
  1. Use of Computer Tracking Technologies.
  • No Tracking of Personal Information. The Website is not set up to track, collect or distribute personal information not entered by visitors. Through Website access logs Iron Fist may collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes for research and development, user analysis and business decision making, all of which provides better services to the public. The statistics garnered, which contain no personal information and cannot be used to gather such information, may also be provided to third parties.
  • Use of Cookies. Iron Fist, or its third-party vendors, collects non-identifiable and personal information through the use of various technologies, including “cookies”. A cookie is an alphanumeric identifier that a Website can transfer to client’s hard drive through client’s browser. The cookie is then stored on client’s computer as an anonymous tag that identifies the client’s computer, but not the client. Cookies may be sent by Iron Fist or its third party vendors. Client can set its browser to notify client before a cookie is received, giving an opportunity to decide whether to accept the cookie. Client may also set its browser to turn off cookies; however, Website may then cease to function properly.
  • Use of Web Beacon Technologies. Iron Fist may, in its sole discretion, utilize web beacons or various other technologies to better tailor its Website to provide better client service. If these technologies are in use, when a visitor accesses these pages of the Website, a non-identifiable notice of that visit is generated which may be processed by Iron Fist or by its suppliers or agents. Web beacons usually work in conjunction with cookies. If client does not want cookie information to be associated with client’s visits to these pages, client can set its browser to turn off cookies; however, web beacons and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.
  • Collection of Non-Identifiable Information. Iron Fist may collect non-identifiable information from user visits to the Website in order to provide better client service. Examples of such collecting shall include but not be limited to: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on the Website; Website and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” Iron Fist or its contractors may use this data to analyze trends and statistics.
  • Collection of Personal Information. Iron Fist collects personal identifying information from client during a transaction. Iron Fist may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help Iron Fist understand trends and patterns. This information is not reviewed at an individual level.
  1. Information Security.
  • Commitment to Online Security. Iron Fist employs physical, electronic and managerial procedures to safeguard the security and integrity of personal information. Billing and payment data is encrypted whenever transmitted or received online. Personal information is accessible only by staff designated to handle online requests or complaints.
  • No Liability for Acts of Third Parties. Iron Fist will exercise all reasonable efforts to safeguard the confidentiality of client personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, Iron Fist shall not be liable for unauthorized disclosure of personal information due to no fault of Iron Fist including, but not limited to, errors in transmission and unauthorized acts of Iron Fist staff and/or third parties.
  1. Privacy Policy Changes and Opt-Out Rights.
  • Changes to Privacy Policy. This privacy notice was last updated on May 25th, 2022. Iron Fist reserves the right to modify or amend its privacy policy at any time. A notice of any material change will be posted on the Website. Accordingly, you should visit the Website and review the privacy policy periodically to determine if any changes have been made. Your continued use of this Website after any changes have been made to the privacy policy signifies and confirms your acceptance of any such changes or amendments to the privacy policy.
  • Opt-Out Right. Client has the right at any time to cease permitting personal information to be collected, used or disclosed by Iron Fist and/or by any third parties with whom Iron Fist has shared and/or transferred such personal information. Right of cancellation may be exercised by contacting Iron Fist via e-mail at [email protected], telephone or postal mail. After processing the cancellation, Iron Fist will delete client or prospective client’s personal information from its data base. Client may not be permitted any further access to or use of the Website following such cancelation or deletion, and will not be entitled to any refund for any products or services purchased from or through Iron Fist to the extent the same require the use of the Website.
  1. Access Rights to Data.
  • Information Maintained by Iron Fist. Upon client’s request, Iron Fist will provide a reasonable description of client’s personally identifiable information that Iron Fist maintains in its data bank. Iron Fist can be contacted by e-mail, telephone or postal mail at the address, each of which is set forth above.
  • Corrections and Changes to Personal Information. Help Iron Fist to keep client personal information accurate. If client’s personal information changes, or if client notes an error upon review of client information that Iron Fist has on file, please promptly e-mail Iron Fist at [email protected] and provide the new or correct information.

Any dispute over privacy between client and Iron Fist is subject to the provisions of this policy and to Iron Fist’s Terms and Conditions of Use, and any contract entered into by and between Iron Fist and client.
